Location And Overall FitI recognize that the Future Land Use Map designates the property as Mixed Use Neighborhood, but that designation does not automatically make this particular PZD appropriate at this intensity.My concern is not with all mixed-use development; my concern is that this specific proposal is too intensive and operationally complex for this location.A project of this scale would be better suited to an area with stronger road capacity, established commercial access, confirmed utility service, and less direct impact on a major public park.Denying this PZD would not reject the Mixed Use Neighborhood designation because a smaller, lower-intensity, and better-defined proposal could still be considered for the property.The City should evaluate the maximum development legally authorized by the PZD, not only the attractive conceptual drawings or general project vision.

Project IntensityThe submitted materials describe up to approximately 71 dwelling units and one residence in the farm area—plus commercial space, farm operations, private streets, parking, and stormwater facilities on roughly 10 acres. City Planning PoliciesThe Future Land Use Categories state that Mixed Use Neighborhoods should include context-appropriate housing and neighborhood commercial uses, with design standards ensuring compatibility between uses.The Comprehensive Land Use Plan calls for housing to be served by an adequate street system and for residential areas to be protected from incompatible adjacent uses.The Comprehensive Land Use Plan directs the City to protect the character and integrity of single-family residential areas.The Comprehensive Land Use Plan states that neighborhood commercial uses should be limited in size to avoid large concentrations of traffic.The Comprehensive Land Use Plan supports using land efficiently in relation to existing public utilities and services, so infrastructure readiness should be demonstrated before rezoning.

Traffic And Road InfrastructureA Future Land Use designation does not prove that the existing roads and intersections can support the maximum development requested today.Traffic analysis should include residents, commercial customers, employees, deliveries, farm operations, visitors, and possible events rather than evaluating only residential traffic.Any traffic study should include representative school-year conditions because a study conducted only during summer may not reflect normal congestion reported near Highway 94, Hayden Road, and nearby connections.The applicant should demonstrate safe sight distance, turning movements, driveway spacing, intersection capacity, and peak-hour operations before the PZD is approved.Growth should be located where the transportation network can support it or where required road improvements are funded and guaranteed before development occurs.This project should not be approved based on the assumption that future road improvements will eventually solve current access or capacity concerns.The project should provide enough parking for residents, guests, customers, employees, deliveries, and events without using nearby streets or City park parking.

Pea Ridge City ParkThe Pea Ridge City Park is a public recreational and civic asset, not an overflow amenity for a private development.The proposed development should not rely on the City park for parking, recreation space, gathering space, event support, or access.The City should ensure that project traffic, deliveries, construction activity, lighting, noise, and events do not interfere with normal use of the Pea Ridge City Park.The Parks Master Plan emphasizes accessibility, community connectivity, safe walking and bicycling, open-space conservation, and protection of community character, all of which should be considered before approving development beside the park.The name “The Village at City Park” should not be treated as evidence that the proposal is compatible with the park.Any pedestrian or bicycle connection to the park should have a defined location, width, accessibility standard, ownership, maintenance responsibility, and hours of use.A proposed park connection may be beneficial, but it should not be used to justify a development that otherwise lacks adequate private open space or parking.

Open Space, Farm, And StormwaterCommercial farming, agri-tourism, stormwater detention, and usable recreational open space serve different purposes and should be calculated separately.Title 15 of the municipal code states that detention or retention ponds and other engineered stormwater facilities may not count toward required recreational space. Accordingly, any area identified as a detention facility should be excluded from the project’s required-recreation-space calculation. If the approximately 28,891-square-foot figure shown or measured from the submitted plan is accurate, that area should not be represented as qualifying recreational space.A commercial farm should not automatically count as resident open space unless access, ownership, operating rules, maintenance, and long-term availability are clearly guaranteed.The City should require a clear calculation showing how much open space will actually be usable by residents after detention, farming, access, and maintenance areas are excluded.The adjacent City park should not compensate for an overbuilt private site with insufficient usable open space.

Compatibility With Nearby HomesCompatibility involves more than architecture; it includes density, height, traffic, parking, lighting, noise, deliveries, signage, and hours of operation.Three-story apartments and mixed-use buildings should have enforceable setbacks, landscaping, screening, and lighting protections where they affect nearby homes.Commercial operating hours, deliveries, signage, outdoor activity, and special events should be limited through binding approval conditions.The City should require clear transitions between the higher-density portions of the project and established single-family neighborhoods.

Infrastructure And Public ServicesThe applicant should confirm water pressure, fire-flow capacity, sanitary-sewer capacity, electrical service, utility easements, and communications infrastructure for the maximum buildout.Fire, police, emergency medical, sanitation, and utility providers should confirm that they can safely serve the proposed private streets and three-story buildings.Infrastructure capacity should be established before rezoning rather than deferred until after the PZD creates development rights.Stormwater ownership, inspection, maintenance, overflow routes, sediment removal, and repair responsibilities should be legally assigned before approval.

Private Streets And Long-Term MaintenanceBecause the interior streets would be private, the City should require binding construction, maintenance, repair, and reserve-funding requirements.The approval documents should identify who owns the private streets and common areas and what happens if an property owners’ association fails to maintain them.Private-street parking should not reduce emergency access or interfere with sanitation, deliveries, utility work, or snow and debris removal.Long-term infrastructure obligations should not be left to future covenants that are not part of the public record at the time of rezoning.

Application ClarityThe application materials should be corrected to provide one consistent number of planning areas, lots, acreage by planning area, and maximum residential units. For example, the executive summary refers to five planning areas while listing Areas A through F, and another section refers to six planning areas.The City and the public should know exactly what is being approved before granting the flexibility of a PZD.The approval should clearly identify which site plan, development standards, access points, open-space areas, and unit counts are legally binding.Future changes to density, access, land uses, open space, or the site layout should require a clearly defined public review process.An internally inconsistent or materially conceptual application should not be approved as a final zoning entitlement unless the legally binding standards and plans are made clear.

Phasing And ConstructionThe City should require a binding phasing plan showing when roads, utilities, stormwater facilities, open space, and park connections will be completed.Amenities used to justify the project should be constructed early enough to serve the residents and activities that depend on them.Construction access, staging, dust, noise, drainage, and protection of the City park and nearby neighborhoods should be addressed before work begins.

Requested ActionI respectfully ask the Planning Commission and City Council to vote no because this specific PZD has not been shown to fit the site or the available infrastructure.I support thoughtful growth, but growth should occur where roads, utilities, public services, and surrounding land uses can support it.The proposal may contain positive ideas, but positive features do not replace the need for complete technical evidence and enforceable development standards.The City should deny this application and encourage the developer to relocate the current concept to a more infrastructure-ready site.The City could consider a substantially lower-intensity proposal for this property in the future, but the current PZD should not be approved as submitted.
